The judiciary instituted an “Enforcement Unit” at the Thimphu District Court yesterday. The unit came into existence as there were frustrations among the public about the lack of a proper mechanism at the district court to enforce the judgments, stated the press release of the Supreme Court.
Prior to the establishment of the unit, the enforcement of the judgments was not so effective.
Led by the Court Registrar, the unit will ensure timely enforcement of the court judgments.
“The unit may consult the deciding judges in cases where enforcement is complex or impossible due to the change in circumstances such as the death of the litigants,” underlined the press release.
From now on, all the benches of the Thimphu District Court will have to forward the case files to the Enforcement Unit on the 11th day after the judgment was pronounced.
“The unit will ensure timely enforcement of court decisions and judgments. It will be based on a first come first basis whereby the individuals will be notified. The judges will no longer have to spend their time implementing the judgments. They can now fast track trials and pronounce judgments,” said Gyembo Dorji, the Registrar General of the Supreme Court.
What is enforcement of judgment?
It is a system of enforcing civil judgments related to the recovery of money, goods and properties.
The judgments can be enforced by a variety of methods including a writ or a warrant. For instance, the judgments for the possession of land can be enforced by a writ or warrant of the possession. The same applies to the possession of goods and money.
