No legal basis to pursue Gyalpoizhing case through court: OAG

The Office of the Attorney General says there is no legal basis to pursue the Gyalpoizhing plot allotment case through the court. “No laws have been violated in the allotments,” states the press release from the attorney general’s office.

The press release goes on to say that there is nothing substantive in the investigation that establishes influential people as having misused power and authority to avail plots in Gyalpoizhing town.   It says the people whose land holdings were acquired for Kurichhu Hydropower project were fully compensated. The release also says the people were even compensated for fruit trees, standing crops and any structures. “They were also given option of land or cash compensation.”

The release also states, if there are any lapses and violations, they were administrative or ethical in nature. But, the office recommends the government to take administrative action against the members of the committee.

Meanwhile, the Anti-Corruption Commission (ACC) said it is too early or premature to respond to the findings. The commission says they will study the OAG’s report first and then comment on the issue.

Earlier, ACC’s investigation had revealed that of the 99 plots allotted, 67 were illegal. Genja terms and conditions, signed between the local authority and the plot beneficiaries, were not enforced.  The Plots Allotment Committee undermined the rule of law and the principle of due diligence, fairness, equity, transparency and check and balance.
