RICBL requests court to dismiss case filed against them by former ED

The legal representative of the Royal Insurance Corporation of Bhutan Limited (RICBL) requested the civil bench of Thimphu District Court to immediately dismiss the case filed against the Board of RICBL by the former Executive Director (ED).

The request was made yesterday. The legal representative said, the former ED has no locus standi to file the case against the Board.

He also explained before the court of law that prior to the release of relieve order, the Board has given former ED the chance to clarify his charges by summoning him in the meeting. The former ED accepted his charges and submitted voluntary resignation.

The legal representative further stated that the decision to relieve the former Executive Director was taken since he failed to carry out his administrative responsibilities and violated the corporation’s code of ethics.

He also submitted that the decision was taken in line with the service rules and regulations, and that the plaintiff (former ED) failed to appeal within 10 working days from the day the decision was made.

The RICBL’s legal representative also said, relieving the former ED from the service was done as per the Anti-Corruption Commission (ACC)’s findings.

However, the plaintiff submitted to the court that he was compelled to resign without giving him a chance to clear his allegations. He also questioned how the Board could take decision as per the ACC’s allegations against him, which hasn’t reached to the court yet.

The former Executive Director defended that the ACC’s letter to RICBL only mentions that the latter may either reinstate or suspend him pending the review of the investigation report of the ACC by the OAG.

He added that since he had retired under compulsion, it is affecting him to find a secured job. The next hearing on the case will be held next week.
