PCAL sues Kuensel for alleged defamation

SamtseCourt-PCAL sues Kuensel on defamationPenden Cement Authority Limited (PCAL) files a defamation case against Kuensel, Bhutan’s National Newspaper. The case was filed at the Samtse Dzongkhag Court yesterday, following a news article on ‘PCAL in Deep Water?’, published on April 9. According to the legal representative of authority, Tshering Dorji, the article lacked objectivity and professionalism and Kuensel has maligned the image of the company.

The letter to the court says ‘the article did not include the views of the management on certain highlighted issues before the publication resulting in misinformation to the public’.

For instance the article ran a story about our inferior quality of cement and a case against PCAL by Gita Devi, who is a third party to us, and where agent has clearly written to us that they did not supply the cement to Gita Devi in West Bengal. Since the case was on the inferior quality of cement, we had the officials from quality control who came and certified us that there was no problem with the quality of cement from our company. Since the case is between the Agent and Gita Devi, who has demanded 40 million rupees in damages; PCAL has nothing to do with it,” said the legal representative.

“We are disappointed,” he added, “because, when the reporter had come to interview our CEO, apart from the sales and financial performance figures, the reporter had failed to seek clarification on the ambiguous recruitment process and on inferior quality of cement. Since the reporter chose to base his article on some anonymous source; the article has negatively affected the reputation of our company.”

Meanwhile, the Managing Director of Kuensel said the paper did not get any legal notice on the court case filed against the paper. The paper said they will cooperate with the legal proceedings.
