High Court alters Gasa District Court’s verdict on LG case

The High Court altered Gasa District Court’s verdict saying there is no need for re-elections for the post of Khamaed Gup.

The verdict, passed Tuesday, said it is not the fault of Gup Kinley Penjor but that of the political party which did not strike out the candidate’s name.

Kinley Penjore’s opponent, Karma Tshering had filed the case with the district court alleging the gup’s association with Bhutan Kuen-Nyam Party while contesting.

However, the High Court found his name was reflected in the political party’s list by mistake.

The verdict also said Election Commission of Bhutan should take an appropriate action against BKP for failing to update the list of their members.

This year, the High Court received five cases related to the Local Government elections.

The verdicts for all the cases have been passed.

According to the Election Act 2008, any cases related to the Local Government elections cannot go beyond High Court.
