ACC appealed to Supreme Court on JPLP tax evasion case

In the JPLP tax evasion case, the Anti-Corruption Commission has appealed to the Supreme Court on August 29th against the judgement passed by the Larger Bench of the High Court last month. 

The larger bench of the High Court overturned the ruling of the High Court’s Bench III and upheld the judgement of the Dungkhag Court where Jatan Lal Prasad, the owner of Jatan Prasad Lal Prasad (JPLP) enterprise in Phuentsholing will be liable to restitute only Nu 14.487 M and additional Nu 7.875 M in back taxes and penalties after the deduction of direct cost.

The bench III of High Court had overturned the lower court’s judgment and sentenced the defendant to 5 years non-compoundable imprisonment term and also increased JPLP’s tax liability from Nu 14.487 M to Nu 126.897 M by including purchase cost after the Office of the Attorney General (OAG) appealed against the lower court’s ruling.

However, the Defendant appealed to the larger bench of the High Court following the bench III’s judgment, where the judgement passed by the Phuentshogling Dungkhag Court was upheld.
