Unsatisfied with the Wangdue Phodrang District Court’s judgment on the case involving the attempt to rape of a minor, the Office of the Attorney General (OAG) appealed to the High Court on Thursday.
The District Court passed its judgement on the 21st of last month sentencing the 35-year-old convict to six and a half years in prison for attempting to rape his 11 years 8 month-old stepdaughter.
However, according to the OAG, the sentence against the convict is less since the nature of the crime is unacceptable where he failed to uphold his fiduciary duty. OAG also added that passing lenient judgement would fail to deter such crimes in the future.
The OAG appeals the convict should get the maximum prison term of third felony degree since he had attempted to commit the statutory rape.
According to the Penal code of Bhutan, A defendant convicted of a felony of the third degree shall be sentenced to a term of imprisonment, a minimum of which shall be five years and a maximum of which shall be less than nine years.
