SC upholds High Court’s judgement on English paper leak case

The Supreme Court has upheld High Court’s judgement on the class 12 English-II paper leak case from 2014.

In December last year, High Court upheld the judgement passed by Paro District Court where the case was first heard in 2015.

Paro District Court sentenced Kuenga Dorji, a civil servant affiliated with Bhutan Council for School Examination and Assessment (BCSEA), to two years compoundable imprisonment for leaking the paper. Compoundable imprisonment means the convict can pay in lieu of prison term.

He was also ordered to pay Nu 1.4m for the losses he caused to the government.

He was found to have leaked the paper to a student a day before the exam in 2014. BCSEA received complaints via phone on December 13 after which investigations began. The case was then forwarded to the Paro Court.

Not satisfied with the decision of the High Court, Kuenga Dorji appealed to the Supreme Court in March this year.

But in a judgement passed yesterday, the Supreme Court said it found the lower court’s judgement reasonable and in line with law.
