High Court dismisses OAG’s case against ACC

The High Court dismissed the case filed in by the Office of Attorney General (OAG) against the Anti-Corruption Commission (ACC) yesterday.

The OAG had filed a case for the second time questioning the legality of ACC prosecuting those involved in the Gyalpoizhing land allotment case.

The High Court said the OAG cannot seek judicial opinion from the High Court as per the Constitution and the Civil and Criminal Procedure Code.

The High Court also said the nature of the controversy relates to the ACC ACT 2011. The ACC Act 2011 mandates the ACC to investigate and refer for prosecution and to prosecute.

It was also dismissed based on the earlier miscellaneous hearing.

The Office of Attorney General filed the case asking the High Court to declare that ACC Act to prosecute was not keeping in view with the OAG’s mandate as reflected in the Constitution.
