OAG requests the larger bench of the High Court to dismiss the appeal by Home Minister’s lawyer

The Office of the Attorney General presented its rebuttal statement to the larger bench of the High Court today pertaining to the case of the false vehicle insurance claim involving the Home Minister. The OAG requested the court to dismiss the appeal made by the defendant and uphold the High Court’s judgment. Earlier last month, the High Court sentenced Home Minister Dasho Sherub Gyeltshen to two months in prison for false vehicle insurance claim worth more than Nu 200,000.

In its rebuttal statement, OAG says there is no proof regarding the occurrence of the accident. And even there is no evidence that Dasho Sherub Gyeltshen reported the incidence through a phone call to the former Executive Director of Royal Insurance Corporation of Bhutan Limited (RICBL). It also states that the insurance policy was made later and the documents were also forged.

Earlier last week, the Home Minister’s lawyer appealed the court to acquit the Home Minister of all the charges since the insurance policy for the disputed vehicle was there from 4th June 2016. The appeal is also based on the evidence of the vehicle accident on the night of 9th June 2016. The lawyer also claims that the insurance claims were made according to the RICBL rules and there is no case of backdating the dates on the policy documents.
